Terms & Conditions

1. Object and Scope

These Terms and Conditions govern all contractual relationships between OSHEKO Svitlana (hereinafter "Lana" or "the photographer"), a professional photographer and sole trader based in French Polynesia, and any individual (hereinafter "the Client") wishing to book a photography session via the website lanaphoto.art.

Any booking made on the website implies full and unconditional acceptance of these Terms and Conditions.

2. Booking and Confirmation

• Bookings are made exclusively online via lanaphoto.art.
• A 50% deposit of the total session price is required upon confirmation, payable online by bank card via the secure Stripe platform.
• The booking is confirmed only upon receipt of the deposit. No time slot is reserved without payment.
• The remaining balance (50%) is due on the day of the session, before it begins.
• An automatic confirmation email summary is sent after the deposit is received.

• Vāhine — €280
• Lagoon — €430
• Motu — €580

Travel fees may apply depending on the island and location chosen, as indicated during booking.

3. Cancellation Policy

Cancellation by the Client

• The 50% deposit is non-refundable in all cases of cancellation initiated by the Client.
• An exception may only be granted if the photographer decides, at their sole discretion, to issue a partial or full refund. This decision is subject to no legal obligation.
• To request a cancellation, the Client must notify the photographer in writing as soon as possible.

Cancellation by Lana

• In the event of cancellation initiated by the photographer, a reschedule will be offered as a priority.
• If no reschedule is possible, the deposit is fully refunded within 5 to 10 business days.

Force Majeure

In the event of a force majeure (cyclone, natural disaster, administrative closure, pandemic, etc.) making the session impossible:

• A rescheduled session will be offered as a priority.
• If no mutually agreeable date is possible, any refund of the deposit is at the photographer's discretion.

4. Liability — Personal Belongings

Clients are solely responsible for their personal belongings (cameras, jewellery, clothing, accessories, documents, valuables, etc.) brought to sessions.

OSHEKO Svitlana cannot under any circumstances be held liable for the loss, theft, damage or misplacement of personal belongings occurring before, during or after the photo session, regardless of the location (beach, lagoon, hotel, public space, boat, etc.).

Clients are strongly advised not to bring valuables that are not essential to the session.

5. Liability — Weather and Environmental Conditions

• Lana cannot be held liable for unfavourable weather conditions (rain, wind, swell, insufficient light, etc.) beyond their control.
• If weather conditions make the session impossible or significantly compromise its quality, a reschedule will be offered as a priority.
• In the event of session impossibility due to the photographer's illness or accident: a full refund of the deposit or a mutually agreed rescheduled date will be offered.

6. Photo Delivery

• Photos are delivered exclusively via the secure client area on lanaphoto.art.
• Standard delivery time is 3 to 6 weeks after the session date.
• The Client has 10 days to download their photos from the client area after they are unlocked by the photographer. After this period, files may be deleted.
• Photos are delivered in high resolution, retouched and selected by the photographer.
• No RAW files are delivered to the Client.

7. Image Rights

By booking a session, the Client authorises OSHEKO Svitlana to use the photos taken during the session for promotional purposes: website, social media, portfolio, press publications, etc.

Clients wishing to opt out of this use must inform the photographer in writing before the session. This opt-out is free of charge.

For minors: written authorisation from the holder(s) of parental authority is required for any use of photos on Lana's communication materials.

8. Copyright

OSHEKO Svitlana retains full copyright over all photos taken during sessions, in accordance with applicable intellectual property law.

Booking grants the Client a personal, non-commercial licence to use the delivered photos: personal printing, sharing on social media for private purposes, family use.

Any commercial use of the photos (publication in media, use by a company, resale, etc.) requires prior written consent from the photographer and may be subject to additional fees.

The Client agrees never to remove the photography credit (@ or Lana's name mention) when sharing on social media.

9. Disputes

These Terms and Conditions are governed by the law applicable in French Polynesia.

In the event of a dispute, an amicable resolution will be sought first. The Client may contact Lana via the website contact form.

Failing amicable resolution, the competent court shall be that of Papeete, French Polynesia.
